Nyxbox

Draft, pending attorney review. This page is not legal advice. Do not rely on it until a lawyer has reviewed it and the reviewed text is published.

Terms of use

Nyxbox is a private desk for the mailboxes you connect. These terms are a draft. They describe how the desk is offered today and will be replaced if an attorney revises them.

Provided as-is

The desk is provided as-is and as-available. There is no warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, title, or non-infringement. There is no warranty that the desk will be uninterrupted, timely, secure, or free of errors, or that mail will be delivered, stored, or synced without loss.

Your responsibilities

You are responsible for the password, authenticator, recovery codes, passkeys, and devices used to open the desk. You are responsible for every mailbox you connect, including the credentials and permissions you grant. You are responsible for keeping those secrets off shared or unlocked devices, and for activity that happens under your sign-in.

No guarantee against unauthorized access

Nyxbox does not guarantee that the desk, a connected mailbox, or a device cannot be accessed without permission. It does not guarantee that a breach, interception, or loss of mail will not happen. Encryption and a second factor reduce risk. They are not a promise that access by someone else is impossible.

Limitation of liability

To the fullest extent the law allows, the operator of Nyxbox is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost mail, data, profits, or business, even if advised that those damages were possible. Liability for direct damages is limited to the amount you paid to use the desk in the twelve months before the claim. If you paid nothing, that limit is one hundred U.S. dollars. Some jurisdictions do not allow these limits. In those places, the limit is the smallest the law allows.

Indemnification

You will indemnify and hold harmless the operator of Nyxbox from claims, losses, and reasonable attorneys’ fees arising out of your use of the desk, the mailboxes and content you connect or send, or your breach of these terms.

Mail at other providers

Mail providers keep their own copies of messages. Disconnecting a mailbox or deleting the Nyxbox desk does not delete mail at that provider. Sending, filing, and blocking through a provider follow that provider’s own rules.

Governing law

Texas law governs these terms, without regard to conflict-of-law rules. Disputes are brought in the state or federal courts located in Texas, and you consent to that venue, except where the law requires otherwise.
